Health in Motion Mobile Application Privacy Policy

Blue Marble Rehab Inc., d/b/a Blue Marble Health ("Blue Marble," "we," "us," "our,") operates the Health in Motion mobile application (the "App"), as part of the services that we provide to healthcare organizations, including clinicians and researchers. This Privacy Policy applies only to Personal Information we collect through the App. It does not apply to information that we collect offline or through other Blue Marble websites or applications. When we use the term "Personal Information" in this Privacy Policy, we mean any information relating to an identified or identifiable person.

Because we operate the App on behalf of healthcare organizations who have subscribed to our services, Personal Information we collect from and about users of the App, including health information relating to patients and study participants, is subject to the terms of our agreements with those healthcare organizations. This Privacy Policy generally describes our collection and handling of that Personal Information, but we do not control, and this Privacy Policy does not apply to, those healthcare organizations' use and disclosure of that information. If you have questions about a healthcare organization's use and disclosure of Personal Information collected through the App, including but not limited to: editing, deletion, and the duration personal data is kept on the platform, please contact that healthcare organization directly.

Please read this Privacy Policy carefully to understand our policies and practices regarding your Personal Information and how we will treat it. By accepting this Privacy Policy during registration, or by using the App, you expressly consent to our collection, use, and disclosure of your Personal Information (as described further below) in accordance with this Privacy Policy.

The Information We Collect

We collect and receive information from and about you through the App in two ways: (1) by receiving information that you choose to provide information to us directly, such as when you use the App to input information about your health by recording health information to your profile or health diary, or by reporting health events to your clinician; and (2) by automatically collecting certain information when you use the App. These methods are described in more detail below.

Information you provide directly

When you use the App, we will collect information that you choose to provide through features and functionality included in the App or that you otherwise provide to us. The Personal Information we collect will vary depending on the features you use, but may include:

• Personal identifiers and authentication information, such as your name, email address, username, and password.
• Demographic information such as your date of birth, gender, and zip/postal code.
• Information about your health and medical history, such as your height and weight, heart rate, blood pressure, allergies, medications, smoking status, and health events like falls, injuries, illnesses, and ER visits.
• Activity information you choose to share with your healthcare organization, such as information about exercises you have completed, test results, and progress in achieving your health goals, which may be shared through forms or other similar functionality, or through photos and videos stored on your device that you upload through the App.
• Other information that you provide in response to questionnaires administered through the App.

Information we collect automatically

In addition to the information you choose to provide to us, we collect some information automatically when you use the App, which may include the following:

• Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, log data, and information about the features and resources that you access and use on or through the App.
• Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
• Location Information. We may collect information about your approximate location, which we may derive from device information such as IP address.

Other third parties may not collect Personal Information over time and across difference Web sites when a user uses the App. The App does not respond to Web browser "do not track" signals.

How We Use Your Information

We may use the information we collect or receive through the App for the following purposes:

• Operating, developing, and improving the App.
• Administering subscriptions to the Blue Marble platform and performing our obligations under our agreements with our healthcare organization customers.
• Communicating with you about the App, including in response to your questions and other communications.
• Analyzing usage trends and patterns and measuring the effectiveness of the App and its features.
• Complying with legal or regulatory requirements, judicial process, and our company policies (including due diligence and contracting activities);
• Securing the App, including protecting against and responding to fraud, illegal activity (such as incidents of hacking or misuse of the App), and claims and other liabilities, including by enforcing our Terms of Use.
• Evaluating or conducting a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceeding.
• For any other purpose that you may authorize or direct at the time we collect your information.

How We Share Your Information

To accomplish the purposes set out above, we may share your information with third parties that may include:

• The healthcare organization with whom you are associated and to whom we provide our services.
• Service providers that perform services on our behalf and under our direction.
• Other third parties as necessary to (a) protect or defend our interests and the legal rights or property; (b) protect the rights, interest and safety and security of the Sites, our organization, or members of the public; (c) protect against fraud, and (d) investigate and prosecute users who engage in behavior that is illegal or harmful to others or to others' property.
• A buyer or other successor or organization in the event of an actual or potential merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceeding.
• With such other parties, or for such other purposes, as you may authorize or direct when we collect the information.
• The phone numbers collected for SMS are not shared to third parties for marketing purposes.

Links to Other Websites and Apps

The App may contain links to other third-party websites and online services provided by third parties. These websites and services are not subject to this Privacy Policy. They are not controlled by Blue Marble and Blue Marble is not responsible for their content or their privacy policies, which may differ from ours. We have not reviewed and make no representations about the accuracy of information on third-party websites and online services, or about their information handling practices. Visits you make to these websites and online services are at your own risk, and we encourage you to review their privacy policies.
